Tenant not paying the rent

(Querist) 31 May 2013 This query is : Resolved 
a tenant has been rented a flat of 1300sq ft in pune since 10 months.

leave & lease license is registered for 11 months.

tenant not paying the rent since 5 months
tenant is also misbehaving.

what legal actions need to be taken hence forth, pls guide.

issue legal notice to licensee to pay arrears of rent with interest . terminate the license ask him to handover vacant possession

Give him a legal notice to pay the arrears of the rent. As per the advice of Mr. Sethi, you can also terminate the licence and ask him to vacate.

Agreed with experts. You may mention the heavy penalty in case of not vacating the flat on due date, in your notice. Take the assistance of local lawyer.

1) 1300 sq ft flat at PUNE if in remote area is worth FIFTY LACS AND if in good area than worth ONE TO FIVE CRORES as of now.

2) So instead of seeking advice on a free public site like this you must engage an expert advocate who has experience in the line for initiating PROMPT legal action.

Sir,
I presume the Leave & License is registered, as per provisions of Section 24 of Maharashtra Rent Control Act 1999.
Please issue a notice terminating the Leave & License forthwith, and asking to vacate the premises and hand over quiet and peaceful possession within 30 days, failing which penal compensation at double the rate of the Leave & License shall be applicable.
If the licensee does not vacate, please take immediate legal steps for the eviction.
