Maintenance case, pls help me.

I came to know that my wife is already married with a guy before our marriage and she hidden this matter from me. And after knowing this matter from reliable source i asked her. She left my house and filed a false case of attempting murder to me and said for monthly maintenance.

I work a delivery man for computer parts and mineral water jar. My monthly income goes approx 3000-4500 depending upon my daily wages. What is the amount that I have to give to my wife as a maintenance. We had a 6 months baby too.

I just know that she had married a guy with a register marriage in the year 2007-2008, I have tried a lot to find a document proof of her previous marriage but i failed. I want to file a divorce but how can i prove that she had a previous register marriage with another guy. AND the court never believe me without any prove.

Right you are.
Obtain the copy of her marriage certificate first then file for nullity.
If you successfully prove your income you told award quantum may be any thing about 2k.

Try to obtain previous marriage proof.
Her earlier residence proof, and neighbour's evidence that she was residing as h-b is also enough. However you are bound to pay mtn for ur 6 months baby.
If u hv no other dependent, court may order you to pay app Rs. 1500 as mtn. pm.

first of all get certified copy of the marriage registration certificate then file annulment case against her if she file ant maintenance case this case will be stay.
