deemed conveyance

(Querist) 19 October 2013 This query is : Resolved 
We had file court case against builder for not conveying the land and building in the name of society.When we appproached housing federation's office for deemed conveyance the lawyer appointrd by them advised us that. Since the matter is subjudice the deemed conveyance is not possible. Kindly advise us whether he is correct.

He is absolutely correct. The case is sub-judice and until the same is not decided, the status legally cannot be changed.

The order is passed in favour of society however the same is not executed hence we have filed another case for contempt of court which is getting delayed. The builder has not paid stamp duty on unsold shops and commercial floors and not in positon to pay the same hence inducted developer to comply with the obligations under mofa act by agreeing to give. Court consent stating that conveyance will be given after redevelopment.
