Respected experts,
Need your advice on following matter:
My client signed a Sub licence agreement with a company for commercial operations and handed over the premises to them subject to payment of sub licence fee monthly and elctricity and water charges...and due to poor drafting of that sub licence agreement there is no specific clause in the agreement which entitles my client to terminate the agreement...now the company is not paying electricity bills and also not poaying the monthly sub licence fee ...it is in arrears of about 40 las now...and every month the company commits default and delay in payments right from inception.....can i still terminate the agreement ? under which section? would it be 106 of tpa to terminate a licence agreement.? please suggest....

your cleint can afford legal fees . it is necessary to go through the terms of license agreement to advise . have you issued legal notice for payment of license fees / electricity bills ? if inspite of notice compnay fails to pay file winding up petition against the company
