Unauthorized construction in certain portion of our terrace

REsptd sir,
We are the owner of the building where we reside with terrace. . The Neighbour has constructed a parapet wall in his terrace by encroaching certain portion of our terrace too. He is in no way connected to my building and hi is entirely a third party.My question is
1. Can we get mandatory injuntn to demolish the parapet wall
2. Can we ask for appointment of advocate commissioner to study the unauthorized construction ?
3. If not pls suggest us in detail

contact a local lawyer . if he has encroached on your terrace you can certainly move court for necessary reliefs . you can ask for demolition of encroachment on your terrace and for appointment of commissioner to inspect the unauthorised construction . you can also complain to municipal corporation

Yes you can file a suit for mandatory injunction, file petition seeking appointment of an advocate commissioner to inspect the suit property and give his reports, besides you can even make a complaint with the municipal authorities over his deviation in construction.
