Housing cooperative society - gujarat co-op. act

Kindly opine on the following issue:

A Housing Co-operative Society of Gujarat intends to sell surplus plot of land.

Whether it can do so on its own or does it require permission from District Registrar of Co-operative Societies?

Is there any prescribed procedure for this?

If possible, kindly mention relevant Section or Case Law.

How the society found that land is lying surplus, which is being measured in inch-by-inch before allotment?

It is the prerogative of the Managent.If you are aggrieved,file a petition with the Registrar to interfere for adopting the bylaw provisions to allotments.

society should keep registrar informed of its decision to sell surplus plot .place issue on agenda get it approved in AGM . invite offers for sale of land . be completely transparent in approach so that no one can point fingers at you at later stage .

Refer the bye laws of the society and if it permit so, may proceed after permission from Registrar of society and by adopting due procedure.
