my wife falsely launched criminal case against me under section 498A indicating that i have beaten her by using iron rod and pressed her to out of my house by locking my door based on this charges, All women Police station inspector registered a complaint and put an FIR under the direction of high court.I have taken for ANTICIPATORY BAIL and while granting A.B judge advised for family counseling.Before this complaint,my wife applied for maintenance case and it is also under family court.
Now she is staying at hostel with my female child and frequently she is coming to my house and scolding me in-front of my neighbors with volcare words and she is telling that she has all rights to visit my house and residing there. I am going to apply for divorce case on mental cruelty

Divorce application is no solution at present stage.
First you must contest the 498 case and maintenance case otherwise your defense will be contradictory.
Law gives right of maintenance to even divorced wife so it will be life long liability and your spouse will harass you with your own money.

you have to fight 498A case on merits . under Dv act your wife has to stay in her matrimonial home . she is entitled to maintenance
