one of my brother married with a muslim girl without any consent of the parents, after marriage he live with her in arented house after a year a male baby born to him, due to social and financial diffculties he daily comes to home and request to mother please take us to the home, my mother became kind and take him and her into home, this is 9 years old case, but now days he quarrel with the mother about properties and mentally disturbe her the mother, i want to know about the right of the son if he marred with other religion, honor of the proprrty is mother not father.

How the property is in the name of your mother, was it purchased by her from her own income? Was it devolved to her by any will or codicil by the ancestor or by your late father? Disclose to opine.If the property stands in the name of your mother then she can give it to any body whom she likes and can deprive your muslim brother.

Firstly just because your brother married a muslim girl, he cannot be treated as an outsider to your family, though you or your mother may renounce him but law will not recognise this. He will be a share holder of the family property as per law in the event of any eligibility fora share in the intestate property, marrying a girl outside the religion will not dis-entitle or bar him from claiming his legitimate share in the intestate property. However, in this case, since it is your mother's own property, he cannot legally demand a right to share in the property during her life time and in case of any arrangement to the disposal of the property by her during her life time, he cannot dispute even that.
