Consumer was charged Rs one lac as theft charges and Rs 32000/- as compounding fees to avoid the criminal offence. I have filed a civil suit and got the stay order of disconnection against Rs one lac from the civil court. The criminal court refuse to grant anticipatory bail.My query is
1. if I deposit Rs 32000/- and on the other hand I won the civil suit in future whether I can get the the refund of Rs 32000/- on the basis of decree which may be passed in my favor.
2. Secondarily can I deposit the compounding charges under protest.
3. Whether the criminal court can pass a conditional order to deposit the compounding charges subject the decision of civil court.

3.Yes but only for the purpose of getting bail only , not for commencement for trial.

1. It depends upon the judgment of the Court.
2. Yes.
3. Criminal Court has nothing to do with the outcome of the civil suit. The offence has already taken place. In practical shape, electricity board withdraws its criminal case if the entire penal amount is deposited by accused may be under protest.
