Hi, i am Indian citizen and my husband has acquired australian citizenship (before he was also indian). My baby was born in Australia and that's why she is also Australian. But we've been living in India for more than a year now.
Here, i want to know if we go for divorce,can i contest for child custody. What are the chances for me. She is just under 4 yrs.
Secondly, if her nationality is a problem to get me my baby, what is the process of making her citizen of india like me, of course, without my husband's consent.
please advice.

Dear Madam ...
since ur child is just 4 years old so there is more chances of getting you as her/his custody ... just good case need to be made for custody of the child ...

yes since the child is too small so there is no bar ... just documents need to prepared in such a way that it can fulfil your needs as well the fulfil the requirement of both the countries...

Thanx.. but still..dont want a separation from her even afer her becoming 5 yrs old. Her father is the best father for her but we both accept we are not a good match. i want him to visit her all his life but custody should be won by me if situation occurs.So..what is the process of making her Indian on documents.

DO not be disheartened or loose hope were there is a WILL there is a WAY so be strong enough .... Until child is ten years custody is given to mother .... just need to file custody case in family court .. she can have dual citizenship....
