Dear Experts,
My query is related to insurance sector.
I have a policy with a Insurance company. Earlier my mother was the nominee in my policy.
But unfortunately last year my both parents expired. Now I have only one sister. She is married. I want to add her as nominee in my insurance policy.
When I request the insurance company to add my sister as nominee then they refuse on the ground that nominee should be under direct blood relation.
But when I checked the Insurance act and IRDA act, I didn't found any such clause there.
Please guide me whether Insurance company is correct or not and what I can do to fight against it.
Thankful in advance.
Regards

Section 39 of the Insurance Act, the nomination only indicated the hand which is authorised to receive the amount. The insurer is discharged of his liability under the policy on making payment to the nominee. This does not however preclude other legal heirs to claim the insured amount in accordance with the India Succession Act.
The policy holder can nominate anyone as 'Nominee' and as many too.....................and if the space in column of 'Nomination' is not sufficient and new sheet be attached.
You may narrate your visits so far by mentioning dates, time, venue, names, and claim that your rights have been violated and you have suffered wastage of precious time, funds......................although you had explained the reason for change in nomination………………(describe the facts)…………………………..and that you have acted swiftly by informing the death o nominee to insurance company………………….and hence the need for change in nomination…….
If your instructions have not been adhered to by the staff of insurance company it is lapse, deficiency at their end…………………….
YOU may supply the Nomination form in original by redg. post and mention the redg. post number in your email………………………….and demand the certified copy of nomination form submitted by you confirmation of registration of nomination , under original seal and signature of competent official be supplied to you by redg. post only so as to reach you in say next 7days.

I have already filed a complaint with the IRDA online complaint service. They will work on my query by 5th July 14. Is the ombudsman is from the insurance company or a seperate person.

Insurance Ombudsman is a different entity.
You may also go thru ‘Regulation of Protection of Policyholders interest’……………………….
Submit a carefully drafted representation as already discussed under proper acknowledgment…………….before you move to Insurance Ombudsman.
The online complaint shall be most probably disposed off by phone calls and it is felt that a call center shall handle it……………………………….and it is also felt that it does not impose any penalty and remain within the private insurance contract that you have signed with insurance company.
Record all calls.
If you are not satisfied you can move further.
