(Querist) 20 November 2009 This query is : Resolved
Dear Sir,
I want to know the defination of "all consequential benefits". What benefits inclued in all consequential benefits.
H. S. Thukral (Expert) 20 November 2009
When the Industrial Court Awards reinstatment of a workman who was terminated illegally, it might award payment of back wages with continuity of service with all consequential benifits. It would mean that the employee has right to claim all the benifits of service which he was entitled to had he not been terminated. Such as Bonus, allowances, Gratuity ( in order to count number of years of service etc.), increments, promotion ( if eligible) etc.
