அன்பார்ந்த வழக்கறிஞர்களே,
என் வயது 65, நான் ஒரு வெல்லம் வியாபாரி, எனக்கு 2 மகன்கள்...
என் மூத்த மகனுக்கு திருமணம் முடிந்து 3 குழந்தைகள் இருக்கு, என் இரண்டாவது மகனுக்கு திருமணம் முடிந்து குழந்தையில்லை, இரண்டாவது மகன் போலியோவினால் பாதிக்கப்பட்டு நடக்க இயலாதவன்...
என் சுய சம்பாத்யத்தில் 3 வீடுகள் வாங்கினேன், அதில் ஒன்றை என் மனைவி பெயரில் வாங்கியுள்ளேன், இரண்டாவது மகன் உடல் ஊனமுற்றவன் என்பதால், அவன் பெயரில் ஒரு வீட்டினை உயில் எழுதிவைத்துவிட்டேன்..
இன்னொரு வீடு என் பெயரில் இருக்கிறது...
ஒரு வாகனவிபத்தில் சிக்கி என் முதுகு எழும்பு முறிந்து சறியாக நடக்க முடியவில்லை...
என் செலவுகளுக்கு வீட்டில் இருந்து வரும் வாடகையை நம்பி உள்ளேன்..
வாடகையை வைத்து நான், எனது மனைவி, என் இரண்டாவது மகன் குடும்பமும் சாப்பிடுகிறோம். என் முதல் மகன் குடியிருக்க ஒரு வீடும் ஒரு கடையும் குடுத்துள்ளேன்.
அதற்கு அவன் எனக்கு எந்த வாடகையும் கொடுப்பதில்லை, எனக்கு எந்த உதவியும் செய்வதில்லை, என்னை வந்து பார்ப்பதும் இல்லை..
என் தந்தை எனக்கு 1/2 ஏக்கர் நிலம் கொடுத்தார், 15 ஆண்டுகளுக்கு முன்னால் அதை என் வியாபார நஷ்டத்தை சமாளிக்க விற்றுவிட்டேன். அது என் பெயரில் இருந்ததால் என் மகங்கள் கையொப்பம்மின்றி அவர்களுக்கு தெரிந்தே விற்றேன்.
இப்போது என் மூத்த மகன் என் பெயரில் உள்ள வீட்டினை அவன் பெயரில் எழுதிக்கொடுக்க வற்புருத்துகிறான், முடியாதென்றால் என் மீது சட்டப்படியான நடவடிக்கை எடுப்பேன் என்றும், எனக்கு வரும் வாடகை பணத்தை வராமல் செய்துவிடுவேன் என்று மிரட்டுகிறான்..
அவன் குடியிருக்கும் வீடு நான் சுயமாக சம்பாதித்து வாங்கி என் பெயரில் இருக்கிறது, போலிஸ், கோர்ட், என்று சென்றாள் அவமானம் என கருதி நான் செல்ல தயங்குகிறேன்...
எனக்கு ஆங்கிலம் தெரியாது, ஆகையால் தமிழில் என் கேள்விகளை சமர்ப்பிக்கிறேன், தயவு செய்து, கீழே வரும் என் கேள்விகளுக்கு ஆலோசனை தாருங்கள்..
1). எனக்கும் என் மனைவிக்கும் மருத்துவ செலவு அதிகமாக வருவதால் என் மூத்த மகனிடம் மாதா மாதம் செலவுக்கு பணம் கேட்க எனக்கு உரிமை உள்ளதா?
2)என் மூத்த மகனால் என் மேல் வழக்கு தொடர்ந்து என் பெயரில் உள்ள சொத்துக்களை அவனால் முடக்க முடியுமா?
3)நான் சம்பாதித்த, என் பெயரில் உள்ள வீட்டில் உட்கார்ந்துகொன்டு என்னிடம் சன்டை போடும், என்னை துன்புருத்தும் என் மகன் மீது சட்டப்பூர்வமாக நடவடிக்கை எடுக்க முடியுமா?
தயவு செய்து எந்த விதமான சட்டப்பூர்வமான நடவடிக்கை எடுத்தாள் நானும், கால்கள் நடக்க முடியாத என் இளைய மகனும் பிரச்சனையின்றி வாழ முடியும் என்ற ஆலோசனையை கூறுங்கள்..

i am ganesan, age 65. I have 2 sons, my first son was married and has 3 sons, my second son was physically disabled due to polio, he also married bt has no son. I am jaggery merchant. I purchased 3 houses 1 s in my wife name,another house i made a will on behalf of my disabled son, remaining one house is in my name. I am getting rent from my property and me, my wife and my disabled son's family r living out of it. In a portion of my house my elder son is living separately wit his family. He never gives me rent nor gives money to meet my expenses. My father gave me 50cent farmland to me, before 15 yrs i sold that land, that land was in my name, so at that time my son's signature nt needed, bt they aware abt it. Bt nw my elder son is threathening me that i have sold that land without his consent and he wil file a case against me and lock al my properties. Also last year i met an accident and injured in my spine, so now.
1)do i hav right to ask money frm my elder son to meet my medical expenses.
2)all the 3 houses are my self earned property, i hav al necessary documents as evidence, so whether my elder son has rights to lock my properties by suing a case against me?
3.)he is residing in a home, which is in my name, he is nt giving any rent, he is nt taking care of me, do i have any right to take legal action against him?

The main issue that your elder son raises is about the 15 cents of land which you sold.
Therefore, you have to give more details about the same. You have to indicate how did your father get that property - (i) whether he purchased it? If so, in which year he purchased it?
If your father (instead of purchasing it) had received the 15 cents of land from his father (i.e. your grand father), in which year your father received it?
When did your father die?
When did your grand father die?

15 cents of land sold by you is claimed to be in your name, how it came in your name and when, who purchased it your father or grandfather or forefathers? You may consult local lawyer and show him te relative documents.
2. You can claim maintenance from your son, if you are not having adequate income and he is well earning.
3. The properties are self acquired and these are not likely to be attached.

There are two issues.
One is 15 cents of land you got from your father and sold it. It is to be determined whether this property is self-acquired property or not for which you please answer the queries of the experts, more particularly, how your father got it, whether he purchased on his own or he got it from his father.
Second is your 3 properties. All the three properties are your self-acquired properties and nobody can claim any right on it. Your eldest son who is living in one portion without paying any rent is at your mercy. If you wish that he should vacate you can take steps in that line.
As regards claiming medical expenses from your son, as he is agitating for the property given to you by your father, do you expect he will take such responsibilities? If you want legal remedy against him, you are required to file maintenance case which he will successfully defend stating that you have source of income and properties. This has to come from children out of their love and affection. Hence my advice is - forget this aspect.

i hav al the xerox copies of my fathers property, he purchased it in the year 1948, and he divided that in to 3 shares and given one share each to my brother, sister and me.. And i sold that land in 1999 for 3 lacs. And i purchased 1 house in1982, 2nd in 1987 and the last one in 1996..

from the details furnished by you, it can be presumed that you inherited your share of property duly partitioned; since the property was allotted as your share you had full rights on it hence you disposed it without taking consent of your children, her is no legal infirmity in this and you donot have to take consent or answer anyone for such disposal; Your elder son cannot claim any right over it since it is not an ancestral property, in case files a suit also it will not sustain.
In your self acquired property where your elder son is now living and occupying for business shop, you can very well ask him to vacate or demand rent from him for both the house and the shop, if he refuses, you can file an eviction suit against him.
Further, if your elder son indulges in torturing you and your wife, you can lodge a criminal complaint against him in the police station.
Take the help of a good lawyer to carry out all these things.
