Retaliation and retribution against employees from company

Hi All,

Requesting Get Some Expert Advice How Should I Proceed In My Case. I Joined Wipro In 2008 And Still Working I Was Promoted As An ASG In Wipro Bpo After An Year Of Calling.I Am Working In The Orginisation As An Asg Till Now.

This All Started When I Saw Some Non Compliance In Wipro Bpo For Not Following Policies And I Raised An Ombuds In 2009. On Basic Of That The Manager Of Hp Kv Was Removed And Tec Lead Was Removed. But Raising The Escalation I Came In The Bad Books Of The Company.

Time Passed By And Management Alawsys Use To Ill Treat Me Which Cannot Be Quantified.

I Raised My Second Escalation As An Ombuds For Industrial Injury Leave And The Same Was Adressed Correctly And Process For IIL Was Changed And Again I Came In Lime Light As A Wistle Blower.

In The Month Of October I Found Some Severe Non Compliance On Floor And Since I Never Wanted To Disclose My Name I Send A Email To My Avp Stating The Full Issue And Raised An Ombuds. Management Tried Their Level Best To Save There Managers But All Were Involved
Parties Involved Were Agents > Asg > Team Leader > Tec Lead > Manager
Now Management Did Not Knew That Ombuds Was Raised Hence They Quickly Threw Some Agents And A Asg And They Asked The Team Leader To Put Down Her Papers As Well. She Raised An Ombuds As Well And Fought For 6 Months And This Case Went To Wipro Legal Cell And After They Interviened They Found That Tec Lead And Manager Was At Fault And Team Leader Was Innocent. I Also Helped The Ombuds Team In The Full Investigation As I Knew What Exactly Happened. This Was The Second Instance On Which A Manager Was Removed On My Escalation.

After This I Found An Agent Selling His Own Software On Calls He Was Taking For Our Process. I Investigated And Send A Proper Mail To The Management And Both The Agents Were Terminated On Integrity.
This Time Again It Was Me.

From Oct 14 To Till Date I Found 4 Major Instances Where My Floor Was Doing Non Compliance And I Started Sharing The Data With Legal And Compliance Team And I Use To Send A Email From Outside Domain To The Full Floor With Data.

The Issue That Cropped Was I Was Right On The Part That I Was Asking My Process Not To Do Non Compliance But On The Contrary I Was Becoming A Pain Cause For 6 Months Floor Was Not Able To Do Non Compliance And Floor Target Was Not Met.

Then I Got A Client Escalation For A Girls In My Team And This Was A Golden Opportunity For Our Management To Chuk Me Out. An SIR Was Raised On Me And A Internal Audit Happened In Which They Concluded That Both Of Us Has To Put Down The Papers.In The Escalation The Girl Was Not Able To Proove Any Thing But This Was The Only Chance For Wipro To Get Rid Of Me.

When I Spoke To Wipro Legal Cell They Have Send Me A Email Stating That I Will Not Be A Part Of Any Retribution Or Retaliation. I Have Send Them A Email To Re Invrstigate The Case As I Was Appherensive That Wipro Will Throw Me Out.

What My Question Is Incase Wipro Ask Me To Put Down My Paper After Investigation Can I File A Case For Harrasment , Retaliation And Retribution.
As I Was A Person Who Was Responsable For So Many Esclation Where Wipro Had To Take Action Against There Managers Hence They Have Framed Me And Chucked Me Out as till the time I was there in the process they were not acchieving targets through out as they were not able to do Non Compliance

Barring this I am a 1 Rater in Wipro for past two years

This is an interesting thread and resolution might be possible.

You have used terminologies that seem to be internal ( but full forms should have been explained) posted that (as given below) and you may post further.
The order of statements in your your posts, has been aligned as per first hand feel of the matter. :

Asking to resign/demanding resignation is offence. You should record it for the sake if irrefutable evidence (audio/visual/witnessed/minutes of meeting sent immediatey/any other form) for use at appropriate time in appropriate forum.
Resignation in such allegations/offences may not fetch you relief and your entire unblemished service record may be blemished…………………….and you may get punished too.

What exactly was the complaint and charge and your explanation by the girl?
Why your explanation was called for? What was your explanation?
Was any show cause notice issued and supplied to you?
What is SIR?
Do you have copy of internal audit laying down that both ofd you shuld put down your papers? Do you have all copies?

Did you send and receive emails from official email id?
Such matters can be communicated from and received at personal email id and reply should preferably be by letters thru Redg. Post and all relvant docs be attached evne if these are in the form of emails/attachments/screenshots etc!

The momment your official email id /access is blocked, you will not have any access. Act ASAP.

Are you removed from Dept/Project etc or employment?
How are you removed;verbally or by written order? Do you have the copy?
The targets, perfromance and Perfromance Vs Target depends upon many parameters that may be out of control of employee.
You have achieved a lot and person that were removed could have caused irrepairable damage,legal and financial injury to the company, law suits etc…………………


Do you have the copies of all HR policies,Service Rules and regulations,Conduct and Discipline Rules,Whistel Blower Policy etc?

Hi All,

First of All I thank all of you in guiding me on the same.

I would like to answer question as stated by Mr Kumar Doab

1) Escalation on the Girl was from client example
We work for Hcl as our client as per the process lead by Hcl if a incoming Hcl customer ask to speak to a supervisor the agent has to connect the call on the same go , but here agent fought with the customer and first took him to a no return zone and then transfered the call to Asg ( Advance Support Group) But she transfered the call to a different ASG not me who spoke with the customer.
Now as per process Agent was suppose to log a case with documentation of why customer asked for Esc and Asg was suppose to document above that what resolution he gave to the customer. Now the Asg who spoke to the customer promised a callback and that was missed reason being after agent and asg took the call , agent again discussed the case with me twisting the statement and I gave a different resolution and callback was not done . The was no monitory loss and customer did not sue Hcl.

SIR means Severe Incident Report its a kind of internal escalation that is raised by the management itself to rectify defects in the process

After they did the audit on this case we were verbally asked to put down papers.

I created an Id from yahoo.com from where I use to send email and I have 25 Odd email send to Avp and legal cell and they responded as well.

They blocked my wipro id and have asked me not to come to office till investigation is over.

Rest Ombuds is raised from a different portal and i can give those details with content shared.

1 Rater means Rank 1 in Asg group of my process in the entire year and I did the same for two years 14-15.
