Validity of notary registration and bond

(Querist) 23 July 2015 This query is : Resolved 
Dear Sir / Madam,

X is a person who purchased the property of B two years ago.now till the date the actual trfer was not made by B.
But now B have a financial problem in such a situation C is ready to buy the same.

Therefore was type of precation are to be made by C while obtaining clear & legal matter.

Kindly Advice the same.

The lawyer that has seen all documents pertaining to this property can draft a suitable deed.


Generic advise without examination of documents won't help you.

Get the property vacated first, execute registered sale deed for title and take possession.

B has to first get the property in his possession physically as well as be records. Without seeing the related papers further opinion given here may even misguide you hence consult a local advocate for further opinion.

The second owner i.e. B has already possession of property from last 18 months.

But the Selling property is belonging to Housing Society it is under regulation of MHADA.

However,can we make Sale cum Possession deed from Original owner with intermediate of Second owner of Property which in possession of B i.e. Second owner.

And what is the validity of "Notary Registration" and the second owner already made the "Notary Reg"from original.

Plz Advise.

Register the sale Deed in favour of C with B as the confirming party stating the facts in the deed itself.

You said that X has purchased the property from B, how, vide a sale deed registered or notarised?
