Application under section 156(3)

(Querist) 11 April 2016 This query is : Resolved
Dear Sir,

Kindly advice as to who should be the opposite party in as case where a vehicle has been stolen but the FIR is not being registered by police.

As far as i understand FIR would be filed against "unknown people".
Ajay Bansal (Expert) 11 April 2016
F.I.R. is always for taking cognizance against commission of crime, not against any person. Mentioning the name of accused is just a formality. So FIR in question will be registered without the name of any accused person.
Nadeem Qureshi (Expert) 11 April 2016
send a complaint regarding your case to concerned SSP and if the police is not going to registered your case within 7 days from that complaint then file a complaint before magistrate u/s 156(30 of Cr.p.C. for registering the FIR regarding your matter.

feel free to call

No need of name of opposite party in FIR.

Dear experts thanks a lot for your concern. I have already sent registered post to the SSP concerned.

As per this i am merely required to address my app to honorable court. I am not required to mention the name of other party ???
