Property of my father who will get if my mom is alive

Dear sir,
My dad expired in sep-15 due to brain hamorage his all insurance and salary of his working company has been transfered to my moms account as my dad has written her name as nominee. My younger brother who got married in nov13 and he had quarrel with my mom and dad for family issues staying alone with his wife and i was staying with my parents as i was single. In few days as said sep 2015 my dad expired and after few months in feb 2016 my mom had a paralysis attack and she was admitted in hospital for almost 2 months he didnt came to help me and my mom. As my mom saw his nature what amount she had she gave me to handle his banking work and to take care of her money what she got from respective insurance companies and my dads company where he use to work. Now in sep 16 he suddenly came and asking his share of money which we got in name of dad..

It is believed that you are Hindu and your father has not left any valid WILL.


ClassI legal heirs of deceased Hindu male i.e. Mother, wife, sons, daughters have equal share.



The amounts is with your mother and not you.



Your mother is sick.




Get details and docs of all amounts spent on funeral of father, treatment of mother etc...............



Let your mother claim maintenance from second son.



If matter can be resolved amicably, nothing like it.


Or let the thankless son taste the bitter ness of litigation and relations.

In the given facts, you mother is entitled to deduct all expenses incurred in connection with the funeral and other expenses related to your father and thereafter the remaining amount is required to be distributed equally among all legal heirs of your father including your brother as er Hindu succession Act.
