APPEAL regarding

(Querist) 13 September 2017 This query is : Resolved
DEAR Experts
I filed a case for specific performance of a contract in 2010 in the honorable Court of senior civil JUDGE (sub court)and the same is decreed by the honorable Court in my favour directing to me pay the balance CONSIDERATION and get the registration of the plot failing which get registration through court as per the procedure.
When I got decree in favour of me immediately I filed a caveat petition in the district court and the same is intimated to the defendants.
In the mean while the defendants preferred an appeal in the high court and I received notices from the high court.
My doubt is to all the experts with out appeal in the district court how the defendant can file an APPEAL before the high court.
Kindly advice on this for which the act of kindness I shall be greatful to.
I alsi filed an EP in the sub court for the process of executing registration and costs and the same is pending for disposal
Thanq experts in advance.

The process of th Execution petition shall have no hurdle because of the High court case provided no stay is granted.

Thanq very much my dear experts.
Please note that with out approaching the defendant to the DISTRICT court for appeal directly how the defendant filed an appeal in the high court. Sub court decreed the matter then the defendant has to prefer an appeal before the district court as the matter comes for the district court.my point is how the defendant is preferred an appeal before the high court.
Kindly give the suitable advice on this point.
Thanq in advance my dear experts.

file application in high court to transfer said appeal to district court who has jurisdiction to try and decide the appeal.
