Hello Learned Sirs,
Can any one guide me on the following subject query.
1.My house was let out on an oral agreement with the tenant who was a Lecturer then.
2.Now the tenant has on 3 different occasions - registered - 3 diferent NGO organizations - stating on the 3 different affidavits that;
3."it is her own house and she is not collecting any rent for running such offices in the let out portion".
the tenant has intentionally cheated the govt.of the fees becoz she has to pay the prescribed fees and with out my permission is running such offices for which i possess authentic proof.
4.WHAT IS THE REMEDY AVAILABLE TO ME, TO FILE A CRIMINAL CASE AND CIVIL CASE.
5.What should be done in such matters to file criminal case and evict the tenant.

You can evict the tenant and also file criminal case against the tenant.

Which state do you belong to? In Bengal evasion of taxes does not give rise to filing a case against the tenant by the landlord. If the acts of the tenant falls within the ground entitling the landlord to file a suit for eviction, then you are free to file.

You may sue the tenant for eviction, inter alia, on the ground of change of user from residential to commercial, nuisance and sub-letting (to NGOs).
You can also launch prosecution against the tenant for filing false affidavits.

you can file a criminal cases on the basis of the false affidavit. For your safety you can publish a public notice in the paper regarding the house property that it is your property but not the tenant etc., to create awareness in the public that tenant is misguiding.
