Sir in our organisation one employee was under suspension w.e.f. Jan-2004 to 2007 and he retired during 2008. He was imposed with a penalty of stoppage of two incrments with cumulative effect. Now what can be done because this punishment cannot be implemented with and he has retired from service. please advise.

Withhelding of arrear of salary
whether arrears of salary can be withheld of a govt. servant who has retired and facing a charge/sheet(RDA pending). As per rule we can withheld gratuity, leave encashment but there is no rule stating that his arrears of pay can be withheld. He has been paid all the pensionary benefits.
