False Complaint of Theft filed against me

(Querist) 10 October 2016 This query is : Resolved
One lady has filed false Complaint of Theft against me and my brother in Police station of Navi Mumbai jurisdiction. The lady was leave & licence holder of a commercial property owned by us. She stopped paying licence fees and never paid any licence fee on time. We gave her notice of vacation of premises. Post that she complained to local police station about theft. Police have unofficially informed me that their investigation has found the complaint to be false. What should I do to further safeguard against the said complaint and how should I ensure legal punishment to the lady for her false complaint??

Mr. Mahesh,

Has police contacted you just to unofficially inform you that their investigation has found the complaint to be false?

What investigation the police resorted to before arriving at their decision?

You should be careful against the acts of police. Police may book you, even not having enough proofs exist against you, sometime on external pressure also, and delay the filing of the charge sheet.

File case for eviction against the lessee.

Agree with expert Goyal.

From the facts posted, your priority should be effecting her eviction than in settling scores on a frivolous complaint.

The opposite party has done so to pressurize you from filing eviction case, you should proceed for eviction case and do not bow before blackmailing.

Thanks to one and all my friends above. I am surely filing eviction proceedings against the licensee. However one of the lawyer friend of mine said that eviction proceedings can be filed with competent Authority under Maharashtra Rent Control Act. But another lawyer friend ( friend of my above lawyer friend and referred by him only) said since the property under question is a commercial premises, it cannot be entertained by Competent Authority but the eviction suit has to be filed in civil court. Please Advice my friends.

Agree with RK Goyal.
