False complaints

(Querist) 05 November 2023 This query is : Resolved
Buyer had purchased an property which was duly registered by sub registrar and mutation also done. After a year the seller being influenced person made complaint to police that money is due from buyer as per agreement. Police also biased. What remedy left to buyer. Please advise urgently.

In the sale deed, the consideration of the sale amount and mode of payment will be mentioned. And the seller while executing the deed will acknowledge the receipt of the amount of consideration. If the same was mentioned in the sale deed it is a proof. Otherwise, the buyer has to prove that the sale amount/consideration was paid.

The sale deed shall have to be registered (only and only) after full and final payment of consideration and the amount of consideration is stated to have been acknowledged by vendor, where is the dispute for booking the purchaser.
Prima facie it is a moot court / fabricated story.
T. Kalaiselvan, Advocate (Expert) 08 November 2023
The police cannot involve in the civil dispute, if at all he had any dues to be collected he should have approached civil court with a suit for recovery.
If the buyer has the details of payments made, he can either approach high court with a quash petition or a discharge petition before the trial court otherwise he can challenge the claim and the allegations in the trial proceedings.
