Employer terminated the employee without any notice or inquiry and also did not pay the salary. After one month employee seni notice to employer to pay his payment of dues. After a thought employer file criminal complaints to police against employee for fraud and cheating using his influence power and money. Although employee was honest and sincere in his job and while in duty no warning ever given by employer. My query is how to save from false complaint and FIR

In which organization are you working? What are the conditions of your appointment letter? If you have completed minimum service you can file a case before the Labour Commissioner or concerned court and defend the allegations/criminal complaints through an advocate.

If the police have registered a FIR then the honest employee should properly challenge the false case on the strength of supporting documents in his possession and on merits

It is private with almost 20 employees. The facts are that employers got websites developed and did not pay and levelled allegations that there was faulty codes and removed the employee whereas website is working properly. When employee sent demand notice to employer that using his money and power the employer files cyber complaint to put pressure on employee.

In terms of appointment letter employee was also authorised to work from home and use his mobile phone and email as deemed fit

If they have filed false case you can challenge the same properly with the help of a skilled lawyer in the local.

If criminal action is set in motion, the issue needs to met on merits. Get a copy of the FIR and Final Report and decide further course of action.
