Q)few days back supreme court order that family member of husband shd not be involved in dowry case without sufficient proof. i want to know that my wife had filed false domestic voilence case against me and my parents. can this order help me to delete name of my parents from this case? if yes how shd i approach court? there is no f.i.r against me and my parents

for Dv case you dont need an FIr . you cna lodge complaint with magistarte . it is necessary to go through the complaint filed by wife . nature of allegations made aginst your parents .

High court is generally reluctant to quash DV cases . better face trial .

unless you narrate the full facts nobody can judge whether DV case against you and your parents is true or not or is it without sufficient proof. Thenonly it can be said whether the said jugement (after reading the judgement) is applicable or not.


A case doe snot become false in the eye of law simply if accused says that it is false.

There cannot be any better free advise on the net. It appears that you are not getting free legal aid (which is available to those who are prima facie innocent). It also appears that you are unable to afford an advocate and still go to the extent of calling you minor son as greedy, questioning the judge’s wisdom in calling for the evidence, questioning the correctness of paltry sum of rs 5800 given as maintenance, want the advise if she can appeal against an order favourable to you.

All this indicates what?

Somewhere you may be wrong for having caused this situation. Average Indian women do no like to go to thana against husband unless compelled.

If you cannot afford litigation or maintenance than peace is the best option which is never costly and available simply by shedding male ego.

Better try amicable settlement if you can.
