We have one house (fathers).my mother ,myself my sister and brother all have equal rights on that house.now my self mother ,sister want to sell the house,my brother is not talking to us after my father death.we want legal advise to sell the property.

for sale of the house you will need your brother consent . ask your mother to talk to him . pay him his share . he will sign the sale papers

You can sell, your undivided equal share in the property to the prospective buyer if someone agrees to buy the same.
However if your brother consents to the same then selling would be a smooth affair.

After the death of your father, you are all will come as a legal heirs of the deceased and will get equal rights in the property. In the absence of any one of the member you cannot sell the entire property. Therefore all are important to sign on the transfer deed.

You all members except your brother can also sell but only to the extent to your share and can provide full possession if your brother is not in possession thereto and let it be a matter between the buyer and your brother if he is not coming to your dictates.
