Fictitious affidavit

(Querist) 12 June 2012 This query is : Resolved
Dear sirs,
In continuation to my queries,my siblings have fabricated a fictitious affidavit forging my late father's signature(Clearly differs from original) back dating 3-5-1995,stating that he in his life time has not executed any family settlement deed challenging Family settlement deed executed favoring me on 21-03-1995,signed by all siblings, their wives,my parents, and i built a house in 1998,my father expired in 2004,and mother in 2010.
The fabricated affidavit was signed by my late mother's cousin brother and 3 brother as witness.

Kindly clarify the permissible time period to challenge any agreement and is such affidavit after 16 years is considered by Court?

Are you in possession of the property? Do you have the original settlement deed signed by your father and others? When did you come to know about the forged affidavit? If you were not made aware of the said fictitious affidavit by other beneficiaries then the limitation will be applicable from the date of your being made aware of the same. Was it already know to you or was made known to you earlier and you did not take any action? If not then you need not worry about limitation.

Forged document can be challanged anytime.

What is the nature of the property and what is the nature of the suit.
