I have issued a cheque amount 50000 to A as help to repair his car in 2008 December 15. He has not used the cheque and kept with him. I also forgot about this since he is very close with me. End of July there were some disputes arrived in between me and A. Suddenly he has deposited the Cheque at the bank and got Endorsement by the bank as Account closed. My account was closed 2009 January 10th.
Now he filed a case that I am cheating him.
What advice on this case.

If the ingredients of Sec.420 IPC are not made out in the complaint you can seek quashing of the same in High court.

Mr. balasubramanium in your case you see that the validity of a cheque is 6 months from the date of issue. you said that there is dispute in end july so it is clear that he can not place the cheque in bank after expire of the period. so raise this point before court,hope you wl get the result.

One more, If the case dismissed can I go for any deformation case since my reputation totally tarnished, suspended from the service.
