Filing appeal in cat or high court

(Querist) 03 March 2017 This query is : Resolved
sir
I was dismissed from railways after departmental inquiry and filed criminal case.
consequent upon my acquittal I represented railway general manager for reinstatement
but no response
then CAT directed respondents to dispose my representation with speaking orders keeping view of acquittal and in accordance with rule and law within 2 months
but no response
then filed contempt application in CAT
then respondents passed order confirming the same punishment issued by disciplinary authority upheld by appeallate authority
the order is not speaking about my acquittal or service rule which permits reinstatement.
but honourable CAT closed the contempt case.
Now should I challenge the order in CAT
or should I challenge the closure of contempt in high court
for quick relief which is better .
I have only 4 months remaining service
kindly advice

What is the order passed by CAT in contempt case?

File a writ petition in High Court through your counsel.

What is the opinion/advise of your lawyer?

Dear sir,
The first application is to consider your representation and the railways have passed orders on that .
Now you move an application before the CAT ,Challaning the railways order on your representation and pray for orders directing the railways to reinstate you in the service.
Approaching CAT will be the right one than filing writ.
