i am 24 got into relationship with student aged 21. we had carnal intercourse for 1 year. he had promised for marriage. his family and my family came to know about this. when asked for marriage he absconded. his family is defaming me by telling my mental health is not good. my mothers health is critical after all this. it has been 8 months. he never returned. i am not getting job in any colleges. can i file a case against him? how to file the case and what evidence is required to prove the case in court?

Many things are not clear. You can file case. Unable to understand why you are not getting job in any college? Is there any link between this case (matter) and reason for not getting job? You can take help from lawyer or authority to sort out / settle this issue.

well okay. I ve researched online quite a lot these days but ive not come across even a single case where guy is inflicted a penalty for cheating. My question is like is it worth fighting for justice? ( i know i am also at fault, i accept it but i m just seeking justice and not revenge)

You can very well lodge a complaint against him for cheating and having sex on the false promise of marriage.
He can be booked under section 417 IPC by which if he is convicted, he may have to undergo imprisonment for 2 years.

i am not convinced with any of the replies! there are so many websites which help men how to get out of cases like dowry, cheating, rape, domestic violence step by step... and there is not a single forum which helps woman. I know what are theoretical laws existing which boast to save women.. I just wanna know if it really works?

Please don't mind, frankly speaking, you won't be convinced with any body's reply, as you have not discussed about any proof against the boy if in hand with you in support of your description. In fact, yours is not a case of demand of justice, rather a case of demand of compensation from the boy's side in the absence of any solid proof against him.
Frankly speaking the acts of both of you were not forced by anyone on anyone of you, rather were voluntary with mutual consent of each other.
About your statement, "besides in ipc 417 cheating against woman is not mentioned or defined," I may point out that general and common Acts of law do not specify any particular sex to which a particular section should apply or not, unless made specifically for a particular sex, e.g., Dowry Act, Cruelty towards women, law pertaining to rape. But, nothing such applies to your case. Even if you prefer to enforce Section 417/IPC, you can do so only if you have some solid proof of promise of marriage by the boy, otherwise not.
As you admitted yourself, "college knows about us. so words spread as to why i had to quit. thus i cant get a job," that makes it clear that if you have lost your school job that is on account of moral turpitude due to your unwarranted immoral behaviour vindicating unbecoming of teacher-student relationship between you and your student that induced your student to establish sexual relationship with his own teacher, a Guru. Naturally, that stance would not have been bearable to school to avoid develiong any such relationships in future.
The school may probably not accommodate you on your job, even if the boy agrees to marry you. So, it was quite irrelevant to link your job with the boy's refusal to marry you.
However, it can be advised that you may contact some local lawyer and discuss with him/her, what type of proof you can produce in support of your claim, so that he/she may make some suitable case against the boy, if cheating actually happened in his relationship with you.

Not accusation, rather based on your own description I tried to make you understand that legally, you don't have any stand on the issue unless you have any solid proof of cheating by the boy on the pretext of marriage with you.
You need not curse yourself, rather take precautions in the future by learning from past mistake.
I have already advised you to contact some local lawyer and discuss with him/her, what type of proof you can produce in support of your claim, so that he/she may make some suitable case against the boy, if cheating actually happened in his relationship with you.

So, after 18 days of my response, when you could not find any logic in your description, as an after thought you decided to stretch the thread unduly!
However, in response to your unwarranted question, I would like to tell you that I not have approached you without any proof with me. I would have approached some capable lawyer, but not without any proof, as is evident from your hypothetical case.

I have replied after 18 days as i had no access to internet. I am not doing well financially. yes i haven't consulted a lawyer. ill be able to do it if you answer a simple question kindly. I am asking if you could kindly cite any cases similar to mine along with judgement. It ll give me as well as others who are reading this thread a rough idea about dealing this issue sir. My only request is please don't be abusive. I am replying to all the threads with faith, my case is not hypothetical.

To find cases is the duty of your own lawyer. I don't prefer to make home work for a lawyer, who charge fee, but desires that others should work free for him, more so when I am not convinced with the facts of the case.
So, if there is any truth in your case, when you hire a lawyer and consult him, he would be supposed to search case laws also. Sorry.

Thank you p.s dingra! An emminent lawyer can cite cases.. Obviously u cannot! My point was there are many threads with cases explained to have better understanding of the issue.. Why is that cheating case not covered?
Anyone reading this thread please don file case if you are in same situation as mine. This is the kind of response you get.. U can browse for cheating cases by bf.. Not only in this forum but many, all the lawyers speak disrespectfully. Besides there are no cases where the cheaters are convicted if girl is more than 18 years and well educated... Its easy to get bail.. Police, lawyers I contacted in my place told the same even though I was ready to pay for the work. I hope and pray no one faces this situation. It's horrible!

I have shifted to different state with family.. I have got small job but I am working with dignity. There are men lecturers who have married their students. Our law system has not mentioned anything against it. I am qualified enough to be a teacher. It's my capability. it is neither disgraceful nor immoral to be in relation with student according to law. Being a lawyer u don't even know this! Your mind is immoral and you are a fraud. On one hand u say my case isnt real, it's hypothetical.. on other u accuse me being involved in this case and I have done wrong.. your mind is twisted. First clear your head!
For your fancy I won't register case as I know what consequences I have to face.
This is my query thread! I'll post whatever I want! Ill not value your baseless foolish arguments in my thread! If u abuse me again here online I'll file a case against you! I will not tolerate this nonsense anymore.
