Filing of f.i.r against builder

my case is as follows
1.the consumer brothers in joint name have purchased the flat from builder. 2builder has mischief the consumers by making number of criminal faults.3the consumer brothers hence preferred the consumer complaint in consumer court .4consumer court appointed the commissioner from his report it is crystal clear that builder has cheated the consumers in numerous ways.his report was never challenged by the builder 5. even then the consumer court has allowed part complaint and avoided to give detailed judgement.6 the consumer brother fought up-to supreme court the supreme court has kept the judgement and order of consumer court in tact.7now my questions are
if one of the brother can file FIR against builder for cheating ,providing false information in deed of declaration etc which is supported by commissioners report.is it necessary to file FIR jointly by two brothers please guide me.8.is their any time limit for filing FIR

order passed by district consumer forum has been confirmed by appellate court including the supreme court .
if criminal case of cheating is made out both the aggreived parties should file complaint of cheating . however do consult a local lawyer before proceeding further
