Filing of supplementary chargesheet

Querist : Anonymous (Querist) 22 December 2020 This query is : Resolved
Sir
my Query is when an investigating agency has filed a chargesheet against a main accused and sums up their final police report that a separate chargesheet will be submitted after obtaining sanction from the appropriate authority, with the charges different (conspiracy to help the accused from getting lesser punishment) from the main charges and stating the charges to be framed. what is the procedure to be followed by the investigating agency.

The facts, as posted, lack clarity. How is it that the alleged supplementary charge sheet is for helping the accused getting lesser punishment?
K Rajasekharan (Expert) 23 December 2020
When police files their final charge sheet in regard to any offence they cannot submit another modified one with more details later on that offence.

However if any other un-investigated matter comes to the attention of the police after filing of the final police report, they can conduct a further investigation and file a further charge sheet on that part of the offence.

Conducting further investigation is a prerogative of the police but it is better to inform the matter to the court so as to avoid some clashes.

Investigating Officer can file supplimentary charge sheet.

Well explained by the expert K. Rajasekharan, agree to it.
