Final report for 498a

Querist : Anonymous (Querist) 10 October 2011 This query is : Resolved 
I am facing 498a from last 3 months. Police did its investigation and did not find any chagres against me.

No they are sendinf a "final report" to court saying that chages are false.

Please help me to understant what will be the procedure now. Can judge still can reject the final report or he is bound to accept it.

Also precautions or steps shall i take so that this case is closed. what my opposite party can do to stop it now

Judge might accept the final report or can order for re-investigation.

The judge can also ask for objections from other party and conduct a trial himself.

Ans: After receiving the Final Report the Magistrate shall have to issue Notice upon the defacto-complainant informing the same. If the defacto-complainant raises objection and prays for re-investigation then it shall be generally allowed. Alternatively the defacto-complainant may pray to the Magistrate to take cognizance and treat it as Private Complaint and examine him on oath u/s 200 Cr.P.C and issue process. In case of no-objection is raised then case shall be closed.

Also precautions or steps shall i take so that this case is closed. what my opposite party can do to stop it now ?

If there is no opposition of the Final report by the complainant side than it is most likely that the Magistrate will accept the Final report and drop the proceedings against you.

Normally the police dont file a closure report and Chargesheet is filed as they do have statements and Affidavits given by the other party in support of their complaint which is sufficent for Police to file a chargesheet.

whats the issue in replying to Anonymous questions there is no guarantee that the people who are asking questions with a valid name do or do not exist in reality. There would be many ID's created through fake names its upto you to abstain from answering.

I would not mind saying that even I am not sure that you 'Sankar Narayanan' do exist in real world or may be is a fake ID dont mind but everything is possible.
