Final settlement and divorce

Querist : Anonymous (Querist) 24 November 2011 This query is : Resolved
My wife had filed a false FIR against me and my parents for dowry harrasment .During Police mediation we reached a settlement
of 20 lakhs ,so that police will not chargesheet me .Meanwhile in the family court we have agreed for mutual seperation and mentioned
that settlement amount in the agreement.

Her lawyer says that after we get the divorce , they will ask the police to file a B report and in that they would mention that
me and my parents are acquitted . They say that would be enough and now a days if we go to courts also , the judge is asking to
to file a B report and close the FIR rather quashing it in the high court.

Is this a correct approach or I am being conned once again by my greedy wife and her lawyer ? Please clarify.

B Report is similar to quashing of FIR so if both parties are agree thereto then there is no need to go to High Court and matter can be got resolved here as per procedure. Your lawyer should also be active.

Whatever you do, do not deliver the money before she writes a petition seeking withdrawal of complaint on the basis of your compromise.

Wait a minute.

Do it in following steps:

1. Let first motion be passed and you pay 50% at that time.

2. Let police file B Report in the interim six months statutory period of waiting, and let it be accepted by the magistrate.

3. Then go for second motion and you pay rest 50% at that time.

Otherwise there are numerous instances of parties taking away whole money and leaving cases in lurch. The police would then expect their share.

BE FIRM ON THE METHOD WHICH IS SUGGESTED, DON'T HANDOVER 100% MONEY AND DIVORCE DECREE BEFORE YOU ARE ACQUITTED.

Kapoor has suggested one way but this is not only and final. It depends upon settlement and middleman to decide what course of action may be adopted as per circumstances and conditions.
