In a petty offence u/ss 160 IPC and under Gambling act court imposed RS 50/- as fine after the confession of quilt by the accused ,now i want to know whether accused who have released by the court after imposing only fine of rs. 50/- will be consider/deemed as acquit or quilty,plz enlighten me on this legal preposition.Thanx in advance

he will be considered as Convict.
he has admitted to his guilt and has been imposed fine.
imposition of fine is also a punishment...mere payment of fine does not absolve a person of his conviction or guilt.

Please note that Court can pass following sentence(punishment: 1. Imprisonment 2. Fine 3. Or both.
In the case of affray, court may pass sentence with imrisonment(upto 1 month)or fine (upto Rs.100/-) or both
In present case, court has passed sentence (punishment) of Rs. 50/- on confession of accused person.Therefore,he is convicted by Court.

in petty offences court follows summary procedure and whn he was fined that means he was found guilty thats why he was punished. so his status is of convict

any confess before the criminal court in a case is a conviction.
in the matter of petty offence as m.v.act ,gambling,excise act(low quantity)could not record in to the police station as convition how ever they are convited by the court.
