Finger print expert

(Querist) 10 September 2012 This query is : Resolved
Dear Experts,

In my case police has taken all the original Thumb impression records from the registrar office through criminal court and the same has been sent to state criminal record bureau for the police finger print experts opinion. Is there any chance to get a fake report from the expert as because my opponent are bribing the entire dept. If so when i get a fake report ,what should i do to fight them?
Kiran Kumar (Expert) 10 September 2012
I dont think there shall be any such apprehension.

still if you find something illegal in the reports then you may challenge the same at appropriate stage.

chances of fake report are remote.

At appropriate stage, take advantage of Forensic Laws to challenge the report, if you are not satisfied with the report. But manipulation in examination is hard.

also to establish sec 293 crpc the pre requisits has to be satisfied. AIR 1974 KER 308. and also consider 'evidence of expert is rather weak type of evidence and the court do not generally consider it as offering "conclusive" proof' 1996 4 SCC 596

It is law of nature that thumb impressions of two different personalities can never resemble.Only those who risk their carrier can provide fake reports on such an issue. It is hand writing where two opinions may be possible.
V R SHROFF (Expert) 10 September 2012
You can hire your own finger prints expert, and get his report, and can cross examine both to prove/ disprove his case.

I have reasons to believe, Exerts are sold off now a days. They dance at the tune of I/O who are managed by interested parties.

Chances of fake report are NOT remote, as far as signatures and handwriting reports are concerned.
Finger prints have less chances but not impossible.
Only photographs would have been supplied of original , keeping Originals with court. So you can get alternate Pvt. Expert report at a time.

Agreed with Mr shroff.
