For Lien of Asst Teacher in UP Basic Education Deptt

Sir my query is that, can a asst teacher in basic edu deptt u.p selected to a higher post is eligible to avail lien on previous post under fundamental rule 13 & 14 until he is on probation in new service. Are FR 13 and 14 applicable to him/her or not?bcoz there is a ruling of allahabad high court in favour of a basic teacher neeraj kumari vs state of up writ no 6740 of 2009 drawing references from FR 13 & 14 for lien.Plz clarify after studying the ruling.

First of all, it does not seem to be your own case, as if an academic query of a student and the category in which the question has been categorise.

Secondly, the question is quite vague in the absence of the confirmation status on the previous post.

Thirdly, relevance of any HC judgment depends upon the characteristics and similarities of the present case with that of the HC case.

Even your present clarification is quite ambiguous. What is the relevance of the term "IF" in your sentence "if an asstt teacher in basic education deptt in u.p can be relieved without resigning by giving a lien on his current post until he is on probation in new post," when you say that it is your own case. Better give proper description of the case with facts & figures, if you really want solution to your problem, if it is real one.
