This query is : Resolved
"DGO - Diploma in Gyeny & Obstetrics" holder practicing doctor used fake/forged MS title under her name and started treatment of a patient, which delivery process go ruined badly resulted in irreversible life threatening damages for patient and her newborn baby.
Can an additional criminal case for cheating / forgery (besides gross medical negligence) be filed against doctor since she had used forged / mischievous MS title under her name, which is printed on duly signed prescription letterhead of that doctor?
Its evidently proven that DGO and MS are not equal qualification as per medical council law of India.

I thank to all for their answers submitted. I have already filed written complaint with state medical council, but ironically they gave clean chit to erring doctor. An appeal against state medical council's order is under scrutiny at MCI, Delhi.
moreover i filed FIR as well for forgery, but police also played their expected role and put an alleged "FR" on that FIR.
FYI i am one of victim of this malpractice case done by grossly negligent gynecologist.

since lower judicial authorities (like local police and state medical council) treated this case lightly and decided it under-influence (deliberately exonerated negligent doctor).
my query here is will i get justice if i take hardship to carry on case-proceedings till higher authorities?
in other words, do higher courts (like high court or supreme court) treat this sort of matters seriously?

Firstly you have to wait for the action taken by the MCI in this regard. You may collect the evidences against the doctor for her falsehood and can file a private complaint with the judicial magistrate if the police are not cooperating or not responsive to the complaint lodged with them.

Thanks Adv. Kalaiselvan... Yeah this i must do as of now.
Also i need to know the following please guide me accordingly:
1. What are the option/procedure acceptable in law to determine "cause of death" in a severely diseased child OTHER THAN Post-Mortem or Autopsy?
2. Can COD be determined by a thorough study of diseased child's medical history, diagnosis test reports, medical prescriptions and prolong treatment taken by child?
3. Is term "VERBAL AUTOPSY" acceptable in eyes of law if an autopsy expert or a group of medical expert issue a certificate concluding his COD based upon child's medical history, his diseased condition, his prolong medical records, diagnostic tests and authentic reliable medical data?
4. FYI: Verbal autopsy had already been used by Govt. of India in medical research and other important issues. Please visit http://www.icmr.nic.in/final/causes_death/causes_death.htm
5. Is there any judgment available which has passed by any high court or supreme court in India so far, in which COD has accepted by court using VERBAL AUTOPSY method?
6. If yes...please provide me the link of that court judgment.
Many thanks.....
