(Querist) 29 January 2011 This query is : Resolved 
if my employer refuses to issue me form 16 can i proceed against him in a court? do i need to issue him a notice?please advise me how to approach if my employer uses such malpractice.

Employer is legally bound to issue F16 which can be very well contested.

You send a notice, the employer will give the certificate.

U may issue notice with a copy to respective it department of your region employer will respond immediately.But whether any appointment order is issued.Whether u worked as an employee or consultant?Some times employer show in their accounts as payment of fees or adjust your payment on any damn voucher not naming you.Whether is employer doing that pratice?

Even if a person is working as a consultant/professional and getting payment professional fees, the employer is bound to issue Form 16A.
