Dear All,
I just got into Exports and am a Export Merchant. I am purchasing goods from a manufacturer. The manufacturer has asked me to furnish CT 1, ARE 1 and Form H as pre order documents he needs> I have not got any registration with Excise department and not with CST. I dont have Excise and VAt Numbers.
My Query is :
Can I just download the form H from web and sign and send it to the Manufacture. or I have to have VAT number first and then I can do it.
Second...I dont have Excise number as well
what is the procedure to get CT 1 and ARE 1.
thirdly: is it mandatory for me to give the manufacturer all these documents.
Fourthly....he excise benefits will be availed by the manufacture...then in that case what all i need to provide him with.
Please advice..

Hi, sanjay, pl. clearly mention whether you have agreed any contract with foreign buyer or not. If you have not any foreign contract at your disposal for export, you can not purchase the material for this purpose, because as per CST Act,1956, you have to purchase material for complying the export contract for merchant/deemed export u/s 5(3) of CST Act,1`956. you have also to get registered before doing the same. You can not download the Form 'H' unless you are a registered dealer. the supply of form H is required to furnish within the next quarter when export take place.
As per ARE & CT1 bond are concerned, you have to get registered with Central Excise as dealer, then all other formalities to be done.

Form-H cannot be downloaded from the website. It will be issued by the sales tax authorities to the registered dealers who exports the goods. For which you need to register with the sales tax authorities to get the Form-H.
With regard to the quiery on obtaining CT-1 certificates, please get registered your self as a merchant exporter with the appropriate Export Promotion council. And based on that you may execute the Bond with central excise authorities for procuring the materials without payment of duty under CT-1 form.

Sanjay, as you said you want to work as export merchant, it means you want to regularly carry on the activities of export. In such case you have to register yourself with-
1. VAT,
2. CST authorities along with
3. excise for procuring the goods and
4. also have to apply for IEC code as one can not import or export without IEC.
My suggestion is that you have to contact some indirect tax consultant for all this matter.
