Formation of a law firm

(Querist) 08 April 2015 This query is : Resolved
Is it mandatory to first form and register a 'Partnership Firm' under the provisions of Partnership Act, 1932 to set up a firm of lawyers? If not, what are the requisite compliance for the same?
Anirudh (Expert) 08 April 2015
If one tries to set up a law firm (not individual practice) it means that two or more lawyers are coming together as partners in setting up a law Firm.

The partnership can be oral or in writing.

The partnership can be registered or unregistered. One has to know the consequences of the un-registered firm. Surely, being a lawyer, you should know about this.

There is no compulsion it should be registered. Registration can take place subsequently at any point of time as per the convenience of the partners. But the main thing is there should be a partnership agreement (which as said earlier can be oral or in writing). As a lawyer you will agree anything in writing is more desirable. The moment the partnership agreement comes into force the existence of the partnership Firm automatically takes place.
