My brother created fradulent documents and grabbed my share of property. I like to file a civil suit and get cancelled the documents. Whether the following judgement help me.
"When a petitioner is not aparty to fraud document no need to pay court fees
ALD 2010 (5) page 94 supreme court."
Can l have comments from any senior Advocate on this judgement

Kindly brief me about the judgement. My point is if i file a cancellation suit can i be excempted from paying court fees since i am not the party to fraud. I am only victim.

You are right. You need not to pay court fee if you were not party signing the doucment, but to draft such a plaint is a skilfull job. You are to use such wordings which do not attract Court Fee.
