Fungus inside beer bottles

(Querist) 30 March 2013 This query is : Resolved
hi, i purchased a case of budweiser premium beer bottles on tuesday,a day before holi, to celebrate with my friends. On wednesday we noticed fungus formation inside the bottles when one of the friend spoke about the taste.we found fungus which is clearly visible floating in all the bottles. The product is still under best before date & is feb,13 manufactured. i have 8 bottles sealed bottles with me.i informed the CC through mail & phone. What should be my course of action. I am a beer lover & like budweiser as a brand but this act has me paranoid about any kind of beer.kindly consider the fact that there is no bill while purchasing beer from the "theka". Also i am not blaming the wine shop as they are not selling expired product.

You should file a consumer case before the local consumer court against (1) the manufacturer, both local office and head office and (2) the owner of the shop where you have purchased the bottles. But as you say, even though there is no fault of shop owner of the beer, as a formality you have to mention the name of the shop and its owner name. Otherwise the case will become weak.

Though you do not have the bill, do now worry. There will be Batch No and serial no. on each and every bottle by which it can be easily identified to which shop it was supplied. After filing of the consumer case, by filing a petition, we can call for the documents of the shop owner (i.e. Registers, Records, account books etc) to the court. Once it is ordered by the court to produce the above records, the shop owner has to produce the documents, otherwise serious action will be taken against him under contempt of court.

"consider the fact that there is no bill while purchasing beer from the "theka". Also i am not blaming the wine shop as they are not selling expired product."

Then persuade them to issue you cash memo/after all you do need to prove you bought it /cash /or credit/no problem.

But what if THEKA colludes with company and alleges it was a gift to you and not a sale at all.???????????

have taken any photograph of the bottle when fungus was there
i saw gutka packet in mineral bottle which was sealed in the newspaper
and now wine shop will give any bill in the shop and only limited outlets will issue you the bill
ask the wine shop a bill for your office purpose because only three days then take action

according to the new uttarakhand law which will be applicable from 1st april all the transactions will be backed by bill proof.Till now the wine shops dont have the concept of bill.Even if we consider that the shopowner colludes with the manf.even then does'nt it come under adulteration?
Devajyoti Barman (Expert) 30 March 2013
do as advised above.
prabhakar singh (Expert) 30 March 2013
It would come under adulteration but you would not come under definition of consumer
unless you have proof that you bought it,cash or credit,no matter.

Even a govt. inspector who proposes to proceed under food adulteration Act is expected to purchase the sample by a bill/cash memo.

just inform manufacturer,
They will not demand bill/ cash memo
They will investigate thru B. No., Dt of mfg, Lable
It can be duplicate.
Mfg have secret dots combinations to detect it.
In Liquor, due to very high Tax , and Profit, and Limited capacity to mfg, crores of duplicate/ cheap material in market.
Many wine shops are sealed, though they pay a Lakh per day as Hafta.
1000 bottled sold, on receiving only 50 as their Quota daily, fetch them 5L profit per day

Govt Inspectors & excise have 50k per day per shop Hafta!! Who will stop it???

Demand is so high, and
ALL WANT TO SAVE TAX.
ALL WANT EASY CASH.
IT'S MONEY THAT DAMAGES HEALTH OF MASS.
& WHO CARES???

YOU GO TO PRESS/ Media, as it affect health of millions. Dry Gujarat have maximum Liver damage death due to drinking of adulterated alcohol, mfg at Daman . Thousands of youngsters dyeing, and nobody investigate their death, and young widows with small kids.
DON'T WORRY ABOUT CASH MEMO
FIGHT FOR HEALTH.
