Getting back a car

(Querist) 13 November 2011 This query is : Resolved 
Dear all,

I have one more query. My husband had owned a car on a loan and paid the full loan amount 2 months before he commit suicide. After his death my father-in-law transfer the car to his daughter name ( I dont know whether legally or illegally).

Kindly clarify can I claim the car from him now?

Probably, your father in law would have already obtained a Transfer form duly signed by your husband.

If it is not so, as a legal heir you have every right over the property. You can send a letter to the RTO office along with your legal heir certificate. They will transfer the car in your name.

On death of your husband in absence of his any 'will' you your children [male female both]and from parent his mother is legal
heir and all shall share equally.

Mr. Sethi meant that has your husband before
his death has sign some sale letter and some forms required by RTO office for change of name which is with or in favor of your father in law.
