Gifted land

Querist : Anonymous (Querist) 13 December 2010 This query is : Resolved 
Respected Advocates,

“A” had gifted a land (self earned) to a private temple some 50 yrs back. It was registered in the name of statue (Dev Murti). The Purohit of the temple rented it to the son of “A’. Now the son and grandson of “A” are claiming the land and have stopped paying the rent. Now what recourse of law should the Purohit take?

The matter can be referred to Commissioner Endowments /Temples Authority an he/Commissioner /Dy Commissioner of Endowments will evict the Tenant -Under the Endowments Act.

yes, after gift none of legal heirs has any title rights over the land and deity is the owner. the eviction proceedings can be initiated against them.

The author says it is a private temple. So, HR&CE can not do anything. The care taker of the private temple can evict the sons, by eviction proceedings.

Actually, it is a private temple established for the home purpose of the Purohit/Pujari.
So, Learned Adv. Arunagiri has suggestion seemed to be appropriate.
