There is no requirement of the statement of the accused during the course of investigation in writing rather the statements of the witnesses are recorded under section 161 of criminal procedure code and the statement should in that event should be supportive to the FIR.

I am an accused in 498a case along with my family of 5 members.
Police thana SO has sent a notice to me asking me to appear for recording the statement.
It is also mentioned that I'd not be arrested as per CrPC Section 41 b provided I comply to certain conditions.
I need your advice on -
1. Is it safe to appear without worry of arrest.
2. Should I sign the statement given by me(if in writing) and take a certified copy.
3. Can I be asked to to give my decision/opinion to them. For example if they ask me to take her back or do settlement by paying money to her.
4. Can there be other party present there in thana and create havoc like they created many time at mediation.

if you appoint a lawyer he will take care when you appear before the police station
you have sign the copy
yes they will ask answer what you think
chances are there they may create havoc
better to consult a lawyer before taking any steps in such matters
