Goa property dispute

(Querist) 30 January 2014 This query is : Resolved
Hi,
A succession deed is made by one brother stating that he is the only son of his mother and father whereas he has 4 other brothers for a land property in goa which was in the name of the Father. he has not been able to sell this land and when the other brothers came to know what he had done they have threaten to file a suit against him in the courts of Goa..I would like to know if it is possible to revoke this deed to succession legally without filing for civil suit? If so then what other legal means can be undertaken to dissolve this false deed of succession? Thanks

How is that done?
If it is not registered then just tear it away.
if it is so then another registered deed of declaration will have to be made.
In any case destroying the deed is an option.

If the deed is not registered you can tearout the same, however if the deed is registered you need to approach court.

you mean to say succession certificate ? if it is issued by making false statement on oath you have to move court for setting it aside

If the succession certificate is issued by the court, court has to be moved for setting it aside.

Thank you all.. as this deed of succession is registered and stamped by the court..basis your advice we will have to approach the courts via a civil suit filed against the brother..I guess this is the only way to revoke it..Thanks All.

Yes you have to apply for revoking the certificate.
