Grandfathers property

(Querist) 23 December 2011 This query is : Resolved
Hello Sir / Madam,

Need your help on understanding about a situation with a property..

My grand father has expired and he had left a small house in his native city. My Grandfathers' 2 daughters and one being my mom and other her younger sister.

So legally how to divide the property,

1. Will that to be partitioned equally between my mom and her sister

OR

2. As Grand children we are three, to my mom - Myself and my younger brother and my aunt has one son. So as grand children can we divide the property into three?

The reason why am asking about this is because it would be nice to know which would be the best practice.

Looking forward for experts advise.

Thanks,
Ravi Kumar

Property is equally divided into two part, one is for your mom and another to aunt

Your grandfather's property shall be devided in two equal parts one for your mother and another for your aunt{mother's sister}.Grandchildren are not entitled to get any share.

You do any math but the ultimate result would be 1/2 and 1/2.

while the shares indicated above are correct, if the property (small house) is not capable of being divided or its utility will be NIl if so divided, the best course is to sell the property and divide the proceeds between ur mother and aunt; or otherwise, one amongst them may reatain the entire house by paying the current market value of the 1/2 share to the other.

It is one half as already advised above.
