I had worked in company for 4 years 9 months so is I eligible for gratuity as per gratuity act 1972 clause section 2A of 240 days deemed to be one year

What is the process if the previous company is not responding as i have marked mails where i got a revert i am not eligible as i hav enot completed five years & now company has stopped responding my mails.

you may notice to company with help of local lawyer and also prepare to filling suit in labour court against company

Quote reference of section of 2A in your reply or send an advocate's notice t the company to pay you gratuity.

You should submit application of gratuity to your employer in FORM ‘I’ and get an acknowlegment.

Wait for their response for 15 days and then approach the controlling authority (Dy. Labor Commissioner).
