Gratuity not paid

Hi,

I got relieved from my company on October 24, 2019 after working for 7 years 8 months of continuous service. I had applied for gratuity by serving Form I to my employer, but they simply replied saying no provision of gratuity in the company. Moreover, I am member in EPF from April 2014.

The company head office is located at NOIDA, but I was working in the Coimbatore branch. Kindly help me on this.

Dear Sundraraj,
You are entitled for gratuity. So you can send notice to your employer for your gratuity and later on approach labour court for recovery of any dues.

You can claim gratuity from company on whose payroll you were employed and not the company you were working. Please clarify that your payroll was on same company for continuous 7 years and 8 months.

If your payroll was continuous you are entitled for gratuity.
