Grounds for contempt of court

(Querist) 19 July 2013 This query is : Resolved 
In a Suit consisting of Head of Department, Government Office as Respondent. A order of Hon'ble High Court in a Writ Petition is marked in the present suit.

The present Respondent was not a party to the Writ Petition whose order was marked in the present suit.

The said Writ Petition relates the subject matter of the suit and matters concerning that of the Present Respondent in the suit.

The Sub-ordinate / Assistant Head of Department, Government Office files a Counter Affidavit in which he certain makes Remarks / finds fault with the matter already Adjudicated by the Hon'ble High Court which has passed orders in favour of the Plaintiff.

Is such action of the sub-ordinate amounts to Contempt of Court?

As the matter is not directly related with that person so such comments by him don't bring him under the umbrella of contemp of court.
